%3Cdiv%20align%3D%22%22%3E%3Cu%3ERental%20Agreement%20Terms%20and%20Conditions%3C%2Fu%3E%3Cbr%3E%0A%3Cbr%3E%0A%3Cdiv%20align%3D%22%22%3E1.%20%26nbsp%3BDefinitions.%20%26nbsp%3B%22Agreement%22%20means%20all%20terms%20and%20conditions%20found%20on%20both%20sides%20of%20this%20form.%20%26nbsp%3B%22You%22%20or%20%22your%22%20means%20the%20person%20identified%20as%20the%20renter%20on%20the%20reverse%2C%20any%20person%20signing%20this%20Agreement%2C%20any%20Authorized%20Driver%20and%20any%20person%20or%20organization%20to%20whom%20charges%20are%20billed%20by%20us%20at%20its%20or%20the%20renter%27s%20direction.%20%26nbsp%3BAll%20persons%20referred%20to%20as%20%22you%22%20or%20%22your%22%20are%20jointly%20and%20severally%20bound%20by%20this%20Agreement%20and%20each%20such%20person%20is%20bound%20by%20the%20actions%20of%20each%20other%20person%20signing%20this%20Agreement.%20%26nbsp%3B%22We%22%2C%20%22our%22%20or%20%22us%22%20means%20the%20independent%20business%20named%20on%20the%20reverse%20side%20of%20this%20Agreement.%20%26nbsp%3B%22Authorized%20Dealer%22%20means%20the%20renter%20and%20any%20additional%20driver%20listed%20by%20us%20on%20this%20Agreement%2C%20provided%20that%20each%20such%20person%20has%20a%20valid%20driver%27s%20license%20and%20is%20at%20least%20age%2025.%20%26nbsp%3BOnly%20Authorized%20Drivers%20may%20operate%20the%20Vehicle.%20%26nbsp%3B%22Vehicle%22%20means%20the%20automobile%2C%20or%20truck%20identified%20in%20this%20Agreement%20and%20any%20vehicle%20we%20substitute%20for%20it%2C%20and%20its%20tires%2C%20tools%2C%20accessories%2C%20equipment%2C%20keys%20and%20Vehicle%20documents.%20%22Physical%20Damage%22%20means%20damage%20to%2C%20or%20loss%20of%2C%20the%20Vehicle%20caused%20by%20collision%20or%20upset%3B%20%26nbsp%3Bit%20does%20not%20include%20comprehensive%20damage%2C%20such%20as%20damage%20to%2C%20or%20loss%20of%2C%20the%20Vehicle%20due%20to%20theft%2C%20vandalism%2C%20act%20of%20nature%2C%20riot%20or%20civil%20disturbance%2C%20hail%2C%20flood%20or%20fire.%20%26nbsp%3Bphysical%20Damage%20includes%20interior%20burn%20holes%2C%20window%20stars%20or%20cracks%20not%20caused%20by%20collision%20or%20upset.%20%26nbsp%3B%22Loss%20of%20use%22%20means%20the%20loss%20of%20our%20right%20to%20use%20the%20Vehicle%20for%20any%20purpose%20due%20to%20damage%20or%20loss%20during%20this%20rental.%20%26nbsp%3BLoss%20of%20use%20is%20calculated%20by%20multiplying%20the%20number%20of%20days%20the%20Vehicle%20is%20damaged%20until%20it%20is%20replaced%20or%20repaired%2C%20times%20the%20daily%20rental%20rate.%26nbsp%3B%3Cbr%3E%0A%3Cbr%3E%0A2.%20%26nbsp%3BRental%2C%20Indemnity%20and%20Warranties.%20%26nbsp%3BThis%20is%20a%20contract%20for%20rental%20of%20the%20Vehicle.%20%26nbsp%3BWe%20may%20repossess%20the%20Vehicle%20at%20your%20expense%20without%20notice%20to%20you%2C%20if%20the%20Vehicle%20is%20abandoned%20or%20used%20in%20violation%20of%20law%20or%20this%20Agreement.%20%26nbsp%3BYou%20agree%20to%20indemnify%20us%2C%20defend%20us%20and%20hold%20us%20harmless%20from%20all%20claims%2C%20liability%2C%20costs%20and%20attorney%20fees%20we%20incur%20resulting%20from%2C%20or%20arising%20out%20of%2C%20this%20rental%20and%20your%20use%20of%20the%20Vehicle.%20%26nbsp%3B%3Cb%3EWe%20make%20no%20warranties%2C%20express%2C%26nbsp%3Bimplied%26nbsp%3Bor%26nbsp%3Bapparent%2C%20regarding%20the%20Vehicle%2C%20no%20warranty%26nbsp%3Bof%26nbsp%3Bmerchantability%26nbsp%3Band%20no%20warranty%20that%20the%20Vehicle%20is%20fit%20for%20a%26nbsp%3Bparticular%26nbsp%3Bpurpose.%3C%2Fb%3E%3Cbr%3E%0A%3Cbr%3E%0A3.%20%26nbsp%3BCondition%20and%20Return%20of%20Vehicle.%20%26nbsp%3BYou%20must%20return%20the%20Vehicle%20to%20our%20rental%20office%20or%20other%20location%20we%20specify%2C%20on%20the%20date%20and%20time%20specified%20in%20this%20Agreement%2C%20and%20in%20the%20same%20condition%20that%20you%20received%20it%2C%20except%20for%20ordinary%20wear.%20%26nbsp%3BIf%20the%20Vehicle%20is%20returned%20after%20closing%20hours%2C%20you%20remain%20responsible%20for%20the%20safety%20of%2C%20and%20any%20damage%20to%2C%20the%20Vehicle%20until%20we%20inspect%20it%20upon%20our%20next%20opening%20for%20business.%20%26nbsp%3BService%20to%20the%20Vehicle%20or%20replacement%20of%20parts%20or%20accessories%20during%20the%20rental%20must%20have%20our%20prior%20approval.%20%26nbsp%3B%3Cbr%3E%0A%3Cbr%3E%0A4.%20%26nbsp%3BResponsibility%20for%20Damage%20or%20Loss%3B%20Reporting%20to%20Police.%20%26nbsp%3BYou%20are%20responsible%20for%20damage%20to%2C%20or%20loss%20or%20theft%20of%2C%20the%20Vehicle%2C%20which%20includes%20the%20cost%20of%20repair%2C%20or%20the%20actual%20cash%20retail%20value%20of%20the%20Vehicle%20on%20the%20date%20of%20the%20loss%20if%20it%20is%20not%20repairable%20or%20if%20we%20elect%20not%20to%20repair%20it%2C%20plus%20loss%20of%20use%2C%20diminished%20value%20of%20the%20Vehicle%20caused%20by%20damage%20to%20it%20or%20repair%20of%20it%2C%20and%20our%20administrative%20expenses%20incurred%20processing%20the%20an%20insurance%20claim%2C%20whether%20or%20not%20you%20are%20at%20fault.%20%26nbsp%3BYou%20must%20report%20all%20accidents%20or%20incidents%20of%20theft%20and%20vandalism%20to%20us%2C%20and%20the%20police%20as%20soon%20as%20you%20discover%20them.%3Cbr%3E%0A%3Cbr%3E%0A5.%20%26nbsp%3B%3Cb%3EWE%20do%20%26nbsp%3Bnot%20waive%20our%20right%20to%20collect%20from%20you%20if%20damage%20to%20the%20Vehicle%3A%20%26nbsp%3B%28a%29%20is%20caused%20by%20anyone%20who%20is%20not%20an%20Authorized%20Driver%2C%20or%20by%20anyone%20whose%20driving%20license%20is%26nbsp%3Bsuspended%26nbsp%3Bin%20any%20jurisdiction%3B%20%28b%29%20is%20caused%20by%20anyone%20under%20the%26nbsp%3Binfluence%20of%20any%20drug%20or%20alcohol%3B%20%28c%29%20is%20caused%20by%20anyone%20who%20obtained%20the%20Vehicle%20or%20extended%20the%20rental%20period%20by%20giving%20us%20false%2C%20fraudulent%20or%20misleading%20information%3B%20%28d%29%20occurs%20while%20the%20Vehicle%3C%2Fb%3E%26nbsp%3B%3Cb%3Eis%20used%20during%20the%20commission%20of%20any%20crime%2C%20other%20than%20a%20minor%20traffic%20violation%3B%20%28e%29%20occurs%20while%20carrying%20persons%20or%20property%20for%20hire%2C%20while%20pushing%20or%20towing%20anything%2C%20during%20any%20race%2C%20speed%20test%20or%20contest%2C%20or%20while%20teaching%20anyone%20to%20drive%3B%20%28f%29%20results%20from%20carrying%20dangerous%20or%20hazardous%20items%20or%20illegal%20material%3B%20%28g%29%20results%20from%20any%20use%20of%20the%20Vehicle%20outside%20of%20the%20geographic%20limitations%20stated%20on%20the%20reverse%3B%20%28h%29%20is%20caused%20by%20driving%20on%20unpaved%20roads%3B%20%28i%29%20occurs%20while%20transporting%20more%20persons%20than%20the%20Vehicle%20has%20seat%20belts%2C%20while%20carrying%20persons%20outside%20the%20passenger%20compartment%2C%20or%20while%20transporting%20children%26nbsp%3Bwithout%26nbsp%3Bapproved%20child%20safety%20seats%20as%20required%20by%20law%3B%20%28j%29%20occurs%20when%20the%26nbsp%3Bodometer%20has%20been%20tampered%20with%20or%26nbsp%3Bdisconnected%3B%20%28k%29%20occurs%20when%20the%20Vehicle%27s%20fluid%20levels%20are%20low%2C%20or%20it%20is%20otherwise%26nbsp%3Breasonable%20to%26nbsp%3Bexpect%26nbsp%3Byou%20%26nbsp%3Bto%20know%20that%20further%20operation%20would%20damage%20the%20Vehicle%3B%20%28l%29%20is%20caused%20by%26nbsp%3Binadequately%26nbsp%3Bsecured%20cargo%3B%20%28m%29%20is%20caused%2C%20where%20applicable%3B%26nbsp%3B%28n%29%20results%20from%20your%20willful%2C%20wanton%20or%20reckless%20ct%20of%20misconduct.%20%28O%29%20If%20dash%20camera%20is%20altered%26nbsp%3Bin%20any%20way%20as%20disconnection%2Cadjusting%2Cpowering%20off%2Cdeletion%26nbsp%3Bof%20video%20or%20damaged.%3C%2Fb%3E%3Cbr%3E%0A%3Cbr%3E%0A6.%20%26nbsp%3BInsurance.%20%26nbsp%3BYou%20agree%20to%20provide%20auto%20liability%2C%20collision%20and%20comprehensive%20insurance%20covering%20you%2C%20us%2C%20and%20the%20Vehicle.%20%26nbsp%3BYou%20are%20responsible%20for%20all%20damage%20or%20loss%20you%20cause%20to%20others.%20%26nbsp%3BWhere%20state%20law%20requires%20us%20to%20provide%20auto%20liability%20insurance%2C%20or%20if%20you%20have%20no%20auto%20liability%20insurance%2C%20we%20provide%20auto%20liability%20insurance%20%28the%20%22Policy%22%29%20that%20is%20secondary%20yo%20any%20other%20valid%20and%20collectible%20insurance%20whether%20primary%2C%20secondary%2C%20excess%20or%20contingent.%20%26nbsp%3BThe%20Policy%20provides%20bodily%20injury%20and%20property%20damage%20liability%20coverage%20with%20limits%20no%20higher%20than%20minimum%20levels%20prescribed%20by%20the%20vehicular%20financial%20responsibility%20laws%20of%20the%20state%20where%20the%20damage%20or%20loss%20occurs.%20%26nbsp%3BYou%20and%20we%20reject%20PIP%2C%20medical%20payments%2C%20no-fault%20and%20uninsured%20and%20under-insured%20motorist%20coverage%2C%20where%20permitted%20by%20law.%20%26nbsp%3BCoverage%20is%20void%20if%20you%20violate%20the%20terms%20of%20this%20Agreement%20or%20if%20you%20fail%20to%20cooperate%20in%20any%20loss%20investigation%20conducted%20by%20us%2C%20or%20our%20insurer.%20%26nbsp%3BGiving%20the%20Vehicle%20to%20an%20unauthorized%20driver%20terminates%20our%20liability%20insurance%20coverage%2C%20if%20any.%3Cbr%3E%0A%3Cbr%3E%0A7.%20%26nbsp%3BCharges.%20%26nbsp%3BYou%20will%20pay%20us%2C%20or%20the%20appropriate%20government%20authorities%2C%20on%20demand%20all%20charges%20due%20us%20under%20this%20Agreement%2C%20including%3B%20%28a%29%20time%20and%20mileage%20for%20the%20period%20you%20keep%20the%20Vehicle%2C%20or%20a%20mileage%20charge%20based%20on%20our%20experience%20if%20the%20odometer%20is%20tampered%20with%20or%20disconnected%3B%20%28b%29%20charges%20for%20additional%20drivers%3B%20%28c%29%20optional%20products%20and%20services%20you%20purchased%3B%20%28d%29%20%24100%20fuel%20charge%2C%20if%20you%20return%20the%20Vehicle%20with%20less%20than%20when%20rented%3B%20%28e%29%20applicable%20taxes%3B%20%28f%29%20all%20parking%2C%20traffic%20and%20toll%20violations%2C%20fines%2C%20citations%2C%20penalties%2C%20forfeitures%2C%20court%20costs%2C%20towing%20and%20storage%20charges%20and%20other%20expenses%20involving%20the%20Vehicle%20assessed%20against%20us%20or%20the%20Vehicle%2C%20unless%20these%20expenses%20are%20our%20fault%3B%20%28g%29%20%2450%2C%20plus%20%245%2Fmile%20for%20every%20mile%20between%20the%20renting%20location%20and%20the%20place%20where%20the%20Vehicle%20is%20returned%2C%20repossessed%20or%20abandoned%2C%20plus%20all%20expenses%20we%20incur%20in%20locating%20and%20recovering%20the%20Vehicle%20if%20you%20fail%20to%20return%20it%20or%20if%20we%20elect%20t%20repossess%20the%20Vehicle%20under%20the%20terms%20of%20this%20Agreement%3B%20%28h%29%20all%20cost%2C%20including%20pre-%20and%20post-judgement%20attorney%20fees%2C%20we%20incur%20collecting%20payment%20from%20you%20or%20otherwise%20enforcing%20or%20defending%20our%20rights%20under%20this%20Agreement%3B%20%28i%29%20a%202%25%20per%20month%20late%20payment%20fee%2C%20or%20the%20maximum%20amount%20allowed%20by%20law%2C%20on%20all%20amounts%20past%20due%3B%20%28j%29%20%2450%20or%20the%20maximum%20amount%20permitted%20by%20law%2C%20whichever%20is%20greater%2C%20if%20you%20pay%20us%20with%20a%20check%20returned%20unpaid%20for%20any%20reason%3B%20and%20%28k%29%20a%20reasonable%20fee%20not%20to%20exceed%20%24350%20to%20clean%20the%20Vehicle%20if%20returned%20substantially%20less%20clean%20than%20when%20rented%3B%20%28l%29%20%2475%20per%20hour%20or%20any%20part%20of%20an%20hour%20additional%20fee%20late%20return%20fee.%3Cbr%3E%0A%3Cbr%3E%0A8.%20%26nbsp%3BDeposit.%20%26nbsp%3BWe%20may%20use%20your%20deposit%20to%20pay%20any%20amounts%20owed%20to%20us%20under%20this%20Agreement.%3Cbr%3E%0A%3Cbr%3E%0A9.%20Your%20Property.%20%26nbsp%3BYou%20release%20us%2C%20our%20agents%20and%20employees%20from%20all%20claims%20for%20loss%20of%2C%20or%20damage%20to%2C%20your%20personal%20property%20or%20that%20of%20any%20other%20person%20that%20we%20received%2C%20handled%20or%20stored%2C%20or%20that%20was%20left%20or%20carried%20in%20or%20on%20the%20Vehicle%20or%20in%20any%20service%20vehicle%20or%20in%20our%20offices%2C%20whether%20or%20not%20the%20loss%20or%20damage%20was%20caused%20by%20our%20negligence%20or%20was%20otherwise%20our%20responsibility.%3Cbr%3E%0A%3Cbr%3E%0A10.%20%26nbsp%3BBreach%20of%20Agreement.%20%26nbsp%3BThe%20acts%20listed%20in%20paragraph%205%2C%20above%20are%20prohibited%20uses%20of%20the%20Vehicle%20and%20breaches%20of%20this%20Agreement.%20%26nbsp%3BYou%20waive%20all%20recourse%20against%20us%20for%20any%20criminal%20reports%20or%20prosecutions%20that%20we%20take%20against%20you%20that%20arise%20out%20of%20your%20breach%20of%20this%20Agreement.%3Cbr%3E%0A%3Cbr%3E%0A11.%20%26nbsp%3BModifications.%20%26nbsp%3BNo%20term%20of%20this%20Agreement%20can%20be%20waived%20or%20modified%20except%20by%20us%20of%20the%20due-in%20date.%20%26nbsp%3BThis%20Agreement%20constitutes%20the%20entire%20agreement%20between%20you%20and%20us.%20%26nbsp%3BAll%20prior%20representations%20and%20agreements%20between%20you%20and%20us%20regarding%20this%20rental%20are%20void.%3Cbr%3E%0A%3Cbr%3E%0A12.%20%26nbsp%3BMiscellaneous.%20%26nbsp%3BA%20waiver%20by%20us%20of%20any%20breach%20of%20this%20Agreement%20is%20not%20a%20waiver%20of%20any%20additional%20breach%20or%20waiver%20of%20the%20performance%20of%20your%20obligations%20under%20this%20Agreement.%20%26nbsp%3BOur%20acceptance%20of%20payment%20from%20you%20or%20our%20failure%2C%20refusal%20or%20neglect%20to%20exercise%20any%20of%20our%20rights%20under%20this%20Agreement%20does%20not%20constitute%20a%20waiver%20of%20any%20other%20provision%20of%20this%20Agreement.%20%26nbsp%3BUnless%20prohibited%20by%20law%2C%20you%20release%20us%20from%20any%20liability%20for%20consequential%2C%20special%20or%20punitive%20damages%20in%20connection%20with%20this%20rental%20or%20the%20reservation%20of%20a%20vehicle.%20%26nbsp%3BIf%20any%20provision%20of%20this%20Agreement%20is%20deemed%20void%20or%20unenforceable%2C%20the%20remaining%20provisions%20are%20valid%20and%20enforceable.%3C%2Fdiv%3E%0A%3C%2Fdiv%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E%0A%3Cbr%3E
